Abstract

The main objective of this essay is to establish a frame of reference that allows us to analyze the regulatory background of the protection of personal data in our country, considering as a starting point the background in the General Constitution of the Republic and in the secondary legislation of both federal and local character, regulating the legal rights of the right to intimacy and privacy. At an intermediate level, the influence of information and communications technologies in the new regulatory framework at the federal level is addressed with the appearance of a new language and legal figures in civil, commercial, procedural and consumer protection legislation. Finally, the appearance of federal and local legislation on access to information and government transparency, the law on the protection of personal data of the State of Colima, as well as the respective regulations by the LFTAIP, allow us to affirm that in an incipient manner a protective framework for personal data has begun to be promoted in our country.
